Terms & Conditions
Article 1. General
1.1 In these general terms and conditions, the following terms are used with the meanings stated below unless explicitly indicated otherwise:
1.1.1 Utrecht Canal Cruises: the user of these general terms and conditions.
1.1.2 Passenger: the consumer or business that, directly or indirectly, enters into an agreement with Utrecht Canal Cruises for participation in a canal cruise organized by Utrecht Canal Cruises (holder of the ticket). The term Passenger also includes any natural or legal person who participates in a canal cruise without having entered into an agreement with Utrecht Canal Cruises.
1.1.3 Ticket: an admission ticket issued by Utrecht Canal Cruises in the form of a digital document with a unique code, granting the Passenger access.
1.2 Utrecht Canal Cruises is a trade name of Sloephurenutrecht.nl B.V. (Chamber of Commerce number: 64644413). These general terms and conditions apply to all bookings and services offered under the name Utrecht Canal Cruises. By entering into an agreement referring to these terms, the Passenger agrees to their applicability.
1.3 Deviations from these general terms and conditions are only valid if expressly agreed upon in writing in advance. The applicability of any general terms and conditions used by the Passenger is explicitly excluded unless otherwise agreed in writing.
1.4 If Utrecht Canal Cruises does not strictly enforce these conditions at any time, this does not mean that it waives the right to require compliance at a later stage. Any lenient application of these terms by Utrecht Canal Cruises does not grant the Passenger any rights.
1.5 If a provision in these general terms and conditions is found to be void or unenforceable, the remaining provisions remain in full force. The void or unenforceable provision shall be replaced by a new provision that aligns as closely as possible with the purpose and intent of the original provision.
1.6 Situations not covered by these general terms and conditions or unclear provisions should be assessed in accordance with the spirit and intent of these terms.
1.7 Utrecht Canal Cruises reserves the right to amend or supplement these general terms and conditions. Minor changes may be made at any time. If the Passenger does not accept a change, they may terminate the agreement up to the date the new terms take effect.
Article 2. Formation and Execution of the Agreement
2.1 The agreement is established as soon as the Passenger purchases a ticket via the Utrecht Canal Cruises website or through an authorized provider with whom Utrecht Canal Cruises collaborates.
2.2 Utrecht Canal Cruises will execute the agreement to the best of its knowledge and ability, in accordance with professional standards and applicable norms at the time.
2.3 If necessary for proper execution, Utrecht Canal Cruises has the right to have certain tasks performed by third parties.
2.4 If needed, Utrecht Canal Cruises may deploy a different boat than originally agreed upon. The replacement boat will be suitable for the booked group size.
2.5 During the canal cruise, Utrecht Canal Cruises may take photo and video material. By agreeing to these general terms and conditions, the Passenger consents to this material being used for commercial purposes.
Article 3. Ticket
3.1 A ticket consists of a digital document with a unique code issued by Utrecht Canal Cruises.
3.2 A ticket is personal and is issued only once. Utrecht Canal Cruises may assume that the ticket holder is the rightful Passenger.
3.3 Reselling tickets to third parties is not allowed unless explicitly authorized by Utrecht Canal Cruises.
3.4 Utrecht Canal Cruises reserves the right to impose a maximum number of tickets per Passenger. The Passenger must adhere to this limit.
3.5 The risk of loss, damage, misuse, or theft of a ticket lies with the Passenger.
3.6 If a ticket has been obtained through fraud, misuse, or other violations, Utrecht Canal Cruises may declare the ticket invalid and/or deny the Passenger access to the cruise.
Article 4. Prices and Payment
4.1 All prices and hourly rates used by Utrecht Canal Cruises, as well as the rates stated in quotations, offers, and price lists, include VAT and other statutory levies unless otherwise stated.
4.2 If a price-determining factor changes after the agreement is established, Utrecht Canal Cruises is entitled to adjust the agreed price accordingly.
4.3 In some cases, promotional prices may apply. These prices are only valid for a specific period and while supplies last. Outside this period, the promotional prices cannot be claimed.
4.4 Utrecht Canal Cruises is not bound by prices that are clearly incorrect, such as typographical or printing errors. No rights can be derived from incorrect pricing information.
4.5 Invoices must be paid within two weeks after confirmation of the cruise. Payment must be made in euros via the payment link provided by email or by bank transfer to an account designated by Utrecht Canal Cruises. Objections to an invoice do not suspend the payment obligation.
4.6 If the Passenger fails to pay within the specified period, Utrecht Canal Cruises is entitled, after at least one payment reminder, to charge statutory interest from the due date until full payment has been made. If advance payment is required and is not received on time, Utrecht Canal Cruises has the right to suspend or cancel the agreement.
4.7 If the Passenger fails to meet their payment obligations, all reasonable collection costs – both judicial and extrajudicial – will be borne by the Passenger. For monetary claims, the Passenger is at least liable for collection costs.
4.8 Payments made by the Passenger will first be applied to outstanding interest and costs and then to the longest overdue invoices, regardless of any indication from the Passenger that the payment relates to a more recent invoice.
4.9 In the event of liquidation, bankruptcy, or suspension of payment by the Passenger, all claims of Utrecht Canal Cruises against the Passenger become immediately due.
Article 5. Obligations of the Passenger
I5.1 The Passenger must provide all requested information, including contact details, to Utrecht Canal Cruises.
5.2 Utrecht Canal Cruises is not responsible for verifying the accuracy of the provided information. Incorrect details may result in denied boarding.
5.3 The Passenger must identify themselves upon request.
5.4 The Passenger must comply with public order, behavior rules, and canal regulations.
5.5 Wild urination, jumping overboard, swimming, and littering are strictly prohibited.
5.6 Fireworks, weapons, and dangerous objects are prohibited on board.
5.7 Late arrival does not entitle the Passenger to compensation or rescheduling.
5.8 Minors must be accompanied by an adult.
5.9 Bringing food and drinks is allowed, but excessive alcohol consumption is prohibited.
5.10 The captain has full authority on board and may interrupt or terminate the cruise for safety reasons.
Article 6. Cancellation, No-show, Suspension and Termination
1.1 The Passenger may cancel or modify a booked canal cruise free of charge up to 24 hours before departure, unless stated otherwise at the time of booking and in accordance with the provisions of this article.
1.2 Within 24 hours before the reservation, cancellation by the Passenger is no longer possible unless a weather warning (Code RED) has been issued by the Royal Netherlands Meteorological Institute (KNMI) for the province where the canal cruise takes place. Cancellations within this period must be communicated in writing to Utrecht Canal Cruises.
1.3 In case of cancellation due to severe weather conditions, the Passenger is liable to pay 25% of the agreed fare to Utrecht Canal Cruises. The Passenger has the option to reschedule the reservation free of charge, with the payment of the canceled reservation being converted into credit. Refunds of paid amounts are not possible.
1.4 Utrecht Canal Cruises has the right to cancel or reschedule purchased tickets up to 7 days before the cruise. If Utrecht Canal Cruises cancels the agreement, it will arrange in consultation with the Passenger for the transfer of outstanding services to third parties, unless the cancellation is due to the Passenger.
1.5 If the Passenger is not present at the designated boarding location on time (No-Show), the ticket will be forfeited without the right to a refund.
1.6 Utrecht Canal Cruises has the right to consider the agreement dissolved without notice of default or judicial intervention if the Passenger:
Is declared bankrupt, applies for a moratorium, or otherwise loses free disposal of their assets;
Passes away or is placed under guardianship;
Fails to pay an invoice within the stipulated period;
Ceases or transfers their business activities.
1.7 In such cases, all claims of Utrecht Canal Cruises against the Passenger become immediately due and payable.
1.8 Claims of Utrecht Canal Cruises against the Passenger become immediately due and payable in the aforementioned cases, without prejudice to other rights of Utrecht Canal Cruises.
Article 7. Liability of Utrecht Canal Cruises
7.1 If Utrecht Canal Cruises is liable, such liability is limited as specified in this article. These limitations do not apply if the damage results from intent or gross negligence by Utrecht Canal Cruises and/or its employees.
7.2 Utrecht Canal Cruises is not liable for damage resulting from incorrect or incomplete information provided by the Passenger (or their guests), unless the inaccuracy or incompleteness should have been known. The Passenger is responsible for providing essential information, such as guests' allergies.
7.3 Utrecht Canal Cruises is not liable for personal injury or (consequential) damage, regardless of the cause, before, during, or as a result of the agreement between Utrecht Canal Cruises and the Passenger.
7.4 Utrecht Canal Cruises is not liable for loss or damage to property brought on board by the Passenger.
7.5 Utrecht Canal Cruises is only liable for direct damage resulting from an attributable failure to fulfill the agreement. Direct damage includes reasonable costs for determining the damage, repair costs, and costs to limit further damage.
7.6 Utrecht Canal Cruises is not liable for indirect damage, such as consequential loss, lost profits, missed savings, or business interruption damage. Nor is it liable in cases of force majeure.
7.7 If Utrecht Canal Cruises is liable, its liability is limited to the amount paid out by its insurer. If the insurer does not provide coverage, liability is limited to the invoice value of the relevant assignment.
7.8 The Passenger indemnifies Utrecht Canal Cruises against all third-party claims arising from the agreement between Utrecht Canal Cruises and the Passenger.This is a frequently asked question?

Article 8. Force Majeure
8.1 Utrecht Canal Cruises is not obliged to fulfill its obligations if hindered by force majeure, including circumstances beyond its control and not attributable to its fault.
8.2 During the period of force majeure, Utrecht Canal Cruises' obligations are suspended. If the force majeure lasts longer than two months, both parties have the right to dissolve the agreement without compensation.
8.3 If part of the agreement has been performed before the force majeure occurs, the Passenger must fulfill their payment obligations for the completed part. Utrecht Canal Cruises may invoice this separately.
8.4 Force majeure includes, among other things, strikes at Utrecht Canal Cruises or third parties and other unforeseen circumstances that prevent the performance of the agreement. Weather conditions are not included and are covered in Articles 6.2 and 6.3.
Article 9. Complaints
9.1 Complaints must be submitted in writing and with reasons to Utrecht Canal Cruises no later than five working days after they arise.
9.2 Utrecht Canal Cruises will communicate its position in writing and with reasons within 14 days of receiving the complaint.
9.3 If a complaint is found to be justified, Utrecht Canal Cruises will still perform the agreed service, unless the Passenger indicates that this has become pointless. If performance is no longer possible or useful, Utrecht Canal Cruises is only liable within the limits of Article 7.
9.4 Complaints do not suspend the Passenger's payment obligation.
Article 10. Applicable Law and Competent Court
10.1 All agreements between Utrecht Canal Cruises and the Passenger to which these general terms and conditions apply are governed by Dutch law.
10.2 All disputes between Utrecht Canal Cruises and the Passenger that cannot be resolved through mutual consultation will be exclusively submitted to the competent court in the district of Amsterdam.
